Terms and Conditions
These Terms and Conditions are agreed between, on the one hand, SCEA Domaine La Yole, Avenue de La Méditerranée 34350 VENDRES, registered with the BEZIERS Trade and Companies Register under SIREN number 776 094 419,
hereinafter referred to as ‘the Seller’.
And, on the other hand, all persons, whether natural or legal, wishing to order one or more products offered by The Seller, hereinafter referred to as ‘the customer’.
These GTC apply to all orders placed via the website www.layolewineresort.com and to all orders received by post or telephone.
Unless expressly agreed in writing by Domaine La Yole, no special conditions may prevail over these GTC.
By placing an order, the customer acknowledges that they have read these GTC and accept their terms.
LEGAL AND PRE-CONTRACTUAL INFORMATION
The sale of alcohol to minors is prohibited, and the Seller reserves the right to refuse an order placed by a Customer who cannot prove that they are of legal age.
It is also reminded that alcohol abuse is dangerous for health and that the Seller's products should be consumed in moderation.
All data appearing on the Website (logos, images, texts and descriptions, drawings, visuals, layouts, etc.) are the exclusive property of the Seller. Any use or reproduction, in whole or in part, without prior authorisation is prohibited.
PRICES AND ORDERING
Our offers are exclusively reserved for private customers and under no circumstances for professional resellers.
The prices indicated are in euros, inclusive of all taxes (in particular applicable VAT, excise duties and any other applicable taxes). The prices displayed are net, excluding postage and delivery costs (see ‘delivery’ in these same GTC).
The seller reserves the right to modify its prices and shipping costs at any time, however, products will be invoiced on the basis of the prices in force at the time of order registration and subject to availability.
Unless otherwise specified, processing, shipping, transport and delivery or postage costs and any other costs are charged as extras, under the conditions indicated on the website www.layolewineresort.com, calculated and indicated prior to the customer's confirmation of the order. However, the seller reserves the right to apply the price in force on the day the order is fulfilled in the event of a postponement of the delivery date requested by the customer.
Prices are net, ex-seller's warehouse, including packaging, unless otherwise specified, and are provided in euros and calculated inclusive of VAT. The payment requested from the customer corresponds to the total amount of the purchase, including these costs.
The customer declares that they have read and accepted these general terms and conditions of sale by ticking the box provided for this purpose before completing the online order process. The customer's confirmation of the order at the end of the online order process constitutes confirmation of their acceptance, without restriction or reservation, of these general terms and conditions of sale.
Any changes to the GTC shall only apply to sales concluded after said change, with the dates appearing on this page and on the order confirmation sent to the Customer serving as proof.
The Seller reserves the right to ask new customers to provide proof of identity and address before definitively confirming their first order.
Payment
Regardless of the payment method chosen, the Seller reserves the right to refuse any order or delivery in the event of refusal of payment authorisation by the bank or total or partial non-payment of a previous order by the Custome
DELIVERY – DELIVERY TIMES – RECEIPT
The conditions below apply only to deliveries within mainland France.

Deliveries are made according to availability and in the order in which orders are received.
The seller is authorised to make full or partial deliveries.
When placing your order, it is essential that you provide us with a telephone number, preferably a mobile number, which we will pass on to the carrier (who mainly communicates by text message). Please do not hesitate to provide further details: urgent call before delivery, door code, leave with caretaker, urgent order, etc.
Delivery times are given as an indication only. Actual delivery will depend on supply and transport availability. Exceeding delivery times shall not give rise to damages or deductions.
In any event, delivery within the specified time frame can only take place if the customer is up to date with their payments to the seller, regardless of the reason.
The seller shall be released from its obligation to deliver in the event of force majeure, such as fire, strike, accident, or inability to obtain supplies.
The delivery deadline varies depending on the customer's address. For addresses in mainland France, it is set at the date of payment + 14 working days. In the event of a delay in shipment, you will be sent an email informing you of any possible impact on the delivery time that was indicated to you.
In the event of a delay in delivery compared to the specified time frame, the customer shall send a registered letter with acknowledgement of receipt to the seller, urging them to fulfil their obligation and allowing them an additional period of twenty (20) days, which is the time necessary for the seller to determine the cause of the delay or non-delivery.
Upon receipt of the goods, it is the customer's responsibility to check the number and integrity of the expected packages in the presence of the delivery driver. In the event of missing or damaged items, specific reservations (number and type of missing and/or broken bottles) must be made to the delivery driver. A report of breakage and/or missing items must be drawn up and signed by the delivery driver and the customer.
The customer has the right to refuse delivery if the product(s) are missing and/or damaged.
The customer must send the report of breakages and/or missing items to the supplier as soon as possible by telephone on 04 67 37 37 85 or by email to infowinery@layolewineresort;com. This report must be sent to the seller within a maximum of 24 hours of receipt of the goods. Failure to do so will result in the customer's claim not being considered.
WITHDRAWAL PERIOD
The customer has a period of fourteen clear days from receipt of the products to exercise their right of withdrawal without having to justify their reasons or pay penalties for exchange or refund, provided that the products are returned in their original packaging and in perfect condition within fourteen (14) days of notification to the seller. If the fourteen-day withdrawal period expires on a Saturday, Sunday or public holiday, it is extended to the next working day.
Returns must be made in their original condition and complete, allowing them to be put back on the market in new condition, accompanied by the purchase invoice. In this context, the customer is liable.
Any damage to the product during this process may invalidate the right of withdrawal. Damaged, soiled or incomplete products will not be accepted.
Return costs are the responsibility of the customer. If the right of withdrawal is exercised, the seller shall reimburse the customer for all sums paid, excluding any delivery costs, as soon as possible and no later than fourteen (14) days after the date of receipt by the seller of the products returned by the customer under the conditions set out in this article.
TRANSFER OF OWNERSHIP
Ownership of the products shall only be transferred to the customer after full payment of the price, regardless of the delivery date of said products.
In the event of non-payment of the full price, the seller shall be entitled to continue with the sale and to demand payment of the full price, unless legal action is taken to recover the goods, in which case any deposits or partial payments made shall be retained by the seller as damages.
All elements of the www.layolewineresort.com website are and remain the exclusive intellectual property of the seller. No one is authorised to reproduce, exploit, rebroadcast or use for any purpose whatsoever, even partially, elements that are software, visual or audio.
COLLECTION FROM POINTS OF SALE - CLICK AND COLLECT ONLINE SHOP OPTION
To be collected within 3 working days of the chosen collection date from the sales cellar. After this period, the Customer must make a new collection appointment with the cellar staff.
If the buyer has chosen to collect the goods from the Seller's point of sale, they will only be delivered to the person who placed the order, upon presentation of a valid identity document. If the person who placed the order is unable to come to the point of sale, they may ask a third party to come in their place. This person must bring their own valid identity document, a letter of authorisation written and signed by the person who placed the order, and a copy of the valid identity document of the person who placed the order.
PERSONAL DATA
In the context of processing the Customer's Personal Data, the Seller undertakes to comply with French and European legislation in force applicable to the processing of personal data, and in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable since 25 May 2018. Under the Regulation, the Customer has the right to access, rectify, restrict and object to the processing, portability and erasure of personal data concerning him/her. The Customer is entitled to withdraw their consent at any time with regard to the processing of their personal data. This right may be exercised by sending a letter to the Seller at the above address.
JURISDICTION – DISPUTES – LIABILITY
Any disputes arising from these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences and repercussions, which cannot be resolved between the seller and the customer, shall be submitted to the competent court in Beziers under the conditions of common law. The customer is informed that they may, in any event, resort to conventional mediation, in particular with the Consumer Mediation Commission (C. consom. art. L 612-1) or to existing sectoral mediation bodies, whose references are listed on the website www.economie.gouv.fr, or to any alternative dispute resolution method (e.g. conciliation) in the event of a dispute.
Furthermore, the seller cannot be held liable for damage resulting from misuse of the purchased product. The seller's warranty is, in any event, limited to the replacement or refund of non-compliant or defective products.
Finally, the seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruption, external intrusion or the presence of computer viruses.
DISPUTES – CONSUMER MEDIATION
In the event of a dispute between the Customer and the company, they shall endeavour to resolve it amicably (the Customer shall send a written complaint to the professional or, where applicable, to the professional's Customer Relations Department).
In the absence of an amicable agreement or in the absence of a response from the professional within a reasonable period of one (1) month, the Customer, as a consumer within the meaning of Article L.133-4 of the French Consumer Code, may, if the disagreement persists, refer the matter free of charge to the competent mediator listed on the list of mediators established by the Commission for the Evaluation and Control of Consumer Mediation in accordance with Article L.615-1 of the French Consumer Code, namely:
